Gardens Phase 3 Work Order & Warranty Information

Effective immediately
service requests will only be completed if the resident is either not home, or agrees to step out of the home, or in a different area of the home (maintaining six feet distance) while our associate completes the service request. Additionally, Maintenance Associates may wear gloves or masks if they choose to when completing service requests. We ask that if you or a family member is ill, or been diagnosed or under quarantine you advise our associates and will only submit emergency service requests.

Please know, these policy adaptations are not indications that there is a reported case of the virus at the community, or implies illness of any kind. It represents instead a proactive approach to this outbreak and our commitment to adopting the best recommended practices to stop the spread of COVID – 19.

No heat
Leaks
Power outages
Gas odors

In the event service is needed, the following procedures must be followed:

TURN OFF THE WATER AT THE MAIN WATER SHUT-OFF VALVE WITHIN YOUR UNIT LOCATED NEAR YOUR WATER HEATER

DO NOT CALL THE SALES OFFICE.
DO NOT CALL THE BUILDER OR HIS STAFF




​RHINEBECK GARDENS WORK ORDER REQUEST GUIDELINES

Please read the following guidelines for the proper use of the
Work Order Request Form:

  • Your home warranty and what is covered.
  • What you are responsible for?
  • What is the responsibility of the Association?
  • Who is responsible, Manufacturer or Tradesmen and why.
  • Who will make the service call?
  • Who will be responsible for costs incurred?

Ownership Info
Your Home Warranty is outlined in the Offering Plan you were given when you bought your new home.

All the elements that are within your home that are on the interior of the Sheetrock are considered owned by the homeowner. The elements inside the walls and on the exterior of the home are “Common Property” and are not owned by you.

The list below represents Items owned exclusively by the Homeowner.
Cabinetry, Tile, Flooring, Carpet, Interior lighting, Switches and Outlets, Electrical Circuit panels, Cable / Data boxes, Sheetrock, painted surfaces, Doors, Garage door Openers , Showers & Tub fixtures, Moldings & trim elements, Appliances, Fireplace unit, Countertops, Stairs , Window treatments, Water Heater, HVAC System Components including the condenser outside your unit and thermostats .

The list below represents Association Responsibility.
Exterior elements such as , Roofing, Siding, Windows & Exterior doors ( except broken Glass) Plumbing within the walls , Fire Sprinkler systems, Water supply systems, Common Sewer Mains, Sidewalks, Driveways , Patio blocks, Exterior vent hoods, Privacy fences, Shrubbery and Trees. Structural elements such as framing, foundations.

There are elements that are shared and the cost for repair could be the responsibility of either the homeowner or the Association depending on the cause of the problem.

Some examples that may help define it are as follows.
  • Clogged toilet, sink - The homeowner
  • Clogged sewer main- Association
  • Cable / data feed wiring to the unit- Association
  • Cable / data wiring within the unit – Home owner
  • Plumbing/Water leak under the sink- Homeowner
  • Plumbing / water leak within the walls- Association

There are also the situations that the homeowner will be responsible for the cost of repairs in their entirety:

Examples: (Some, not all)
  • Drive nails / screws and break a pipe in the wall causing a leak.
  • Bump or break a sprinkler head causing a leak or discharge.
  • Drive nails / screws and hit a wire causing a short or fire.
  • Fail to maintain heat within your unit causing broken pipes.
  • Leave your garage door open that causes a freeze up / broken pipe or sprinkler head discharge within in the garage.
  • Water damage caused by negligence to adjoining units and the structure of the building.
  • Kitchen fires causing sprinkler discharge resulting in flooding, smoke damage, building structure damage.


Please enter only one item per Work Order Ticket. This will allow us to give out the task to the proper person.
Fill out all the required information above. You will be contacted by the builder’s representative to discuss the issue. It may require a visit to examine the issue to determine the appropriate action to be taken. Once the contact is made, the request will be scheduled based on urgency and availability of all parties. Service for non-emergencies will be performed during business hours 9-5 Monday through Friday.

​Gardens Phase 3 Warranty
Your Units elements, fixtures & appliances are under warranty for one year from your purchase date.

The walls & trim have been inspected at the time of purchase and have been accepted by you, the buyer. Periodically, there can be minor cosmetic issues, separations of the trim elements that may occur. This is not a defect, but a result of shrinkage, settling and or expansion and contraction of the components used in the building process. The Builders warranty will address these issues one time within the first 12 months of ownership. Usually it just requires a touch up with caulk or Spackle and paint to correct them. It is suggested you allow a period of at least10 months to see if any of these issues occur and they will be addressed all at one time by submitting a work order. The builder will not address these repeatedly as they occur, but at one time during the 12 months. Seasonal change can have an effect on the expansion and contraction movement within the home, so it is best to live thru the seasonal change before requesting service.

Appliances
REFRIGERATOR , ELECTRIC RANGE, DISHWASHER, MICROWAVE, CLOTHES WASHER, CLOTHES DRYER & FIREPLACE.

Warranty is from the manufacturer and will be serviced by the manufacturer, not the builder. It is the responsibility of the homeowner to register all their equipment with the manufacturer for the warranty to be valid. The builder will not be held responsible for equipment failures of these appliances and will not repair or replace them.

Equipment / Fixtures
AIR HANDLER, CONDENSER, THERMOSTATS, TOILETS, SHOWER/TUB FIXTURES, WATER HEATER, CABINETRY, FAUCETS, SINKS, LIGHT FIXTURES, SMOKE DETECTORS (NOT BATTERIES), EXHAUST FANS, FIREPLACE, DOOR HARDWARE, SWITCHES, RECEPTACLE OUTLETS, CIRCUIT BREAKERS, GARAGE DOOR OPENER, PLUMBING VALVES & FITTINGS, TILE, WOOD FLOORS, CARPET.

Warranty for these items will be the responsibility of the builder and the applicable tradesmen to repair or replace as needed, any item found to be defective in material or workmanship for a period of 1 year from the date of your closing. The builder will absorb all the costs incurred to rectify the issue. The builder will be responsible to arrange whatever tradesmen needed for the corrections. Improper use, failure to maintain, and negligence of any of these items will void the warranty and the responsibility of the builder to repair or replace and the full cost of repair will be the homeowners.

HVAC Systems must have a maintenance agreement in place to assure proper care and use. The homeowner has been given the appropriate documents to establish the necessary maintenance agreements. Failure to do so will absolve the builder of that responsibility and the homeowner will have the manufacturers warranty only.
